The African Commission on Human and Peoples’ Rights (ACHPR) adopted the Guiding Principles at its 77th session, held in Arusha, Tanzania. The Guiding Principles form part of African regional norms and consolidate the protection accorded to refugees, asylum seekers, and other migrants under existing African regional and global legal instruments. In addition, the Guiding Principles contain a number of significant features, including:

  1. The broad definition of the term ‘migrant,’
  2. The first definition of the terms ‘climate migrant’ and ‘climate refugee,’
  3. The liberal recognition of the rights of migrants,
  4. Provisions concerning enforced disappearances and missing migrants, including state obligations relating to search on the high seas, and
  5. State obligations regarding the protection of the rights of migrants in the diaspora.

The development of the Guiding Principles was spearheaded by Madam Maya Sahli-Fadel, former ACHPR Commissioner and Special Rapporteur on the Rights of Refugees, Asylum Seekers, Internally Displaced Persons and Migrants in Africa. It also received various forms of support from several individuals and organisations, including from the Centre for Human Rights.

The webinar is aimed at exploring and promoting the significance of the Guiding Principles in the advancement of the rights of refugees, asylum seekers, and other migrants in Africa and beyond. It will feature Prof Luwam Dirar, who provided  expert support to the ACHPR in the development of the Guiding Principles.
