The African Charter on Human and Peoples’ Rights was adopted by the OAU Assembly of Heads of State and Government in Nairobi, Kenya, on 27 June 1981. Twenty years ago, in March 2001, the Centre for Human Rights, University of Pretoria, organised a conference with the title ‘The future of the African regional human rights system’ to reflect on the achievements of the system and the need for reform to further human rights on the African continent. Papers from the conference was published in the newly launched African Human Rights Law Journal. Among these papers were ‘The African regional human rights system: In need for reform?’ by Professor Christof Heyns, the then director of the Centre for Human Rights. Professor Heyns concluded his article by noting that engaging in debates about reform of the African regional human rights system ‘is to exercise a form of ownership, and to say that since the Charter belongs to all of us, it is up to us to continuously ensure its improvement.’ Professor Heyns continued his engagement with the African regional human rights system, and with international human rights law more broadly, over the next two decades until his untimely passing in March 2021, aged 62.

La Charte africaine des droits de l’homme et des peuples a été adoptée par l’Assemblée des chefs d’État et de gouvernement de l’OUA à Nairobi, au Kenya, le 27 juin 1981. Il y a vingt ans, en mars 2001, le Centre for Human Rights de l’Université de Pretoria a organisé une conférence sur « L’avenir du système régional africain des droits de l’homme » afin de réfléchir sur les progrès du système et la nécessité de réforme pour une protection effective des droits de l’homme en Afrique. Les articles de la conférence ont été publiés dans la African Human Rights Law Journal nouvellement créée. De ces articles, figurait « ’The African regional human rights system: In need for reform?’ » (Le système régional africain des droits de l’homme : Nécessité de réforme ?) rédigé par le professeur Christof Heyns, alors directeur du Centre for Human Rights. Le professeur Heyns a conclu son article en notant que s’engager dans des débats sur la réforme du système régional africain des droits de l’homme « revient à exercer une forme d’appropriation, et à dire que puisque la Charte nous appartient tous, c’est à nous de veiller continuellement à son amélioration ». Le professeur Heyns a poursuivi son engagement sur le système régional africain des droits de l’homme, et plus largement sur le droit international des droits de l’homme, au cours des deux décennies suivantes, jusqu’à son décès inopiné en mars 2021, à l’âge de 62 ans.
