The Centre for Human Rights, Faculty of Law, University of Pretoria is deeply concerned about the recent decision of the Government of the Republic of Tunisia to withdraw its declaration made under article 34(6) of the Protocol to the African Charter on Human and Peoples’ Rights on the Establishment of an African Court on Human and Peoples’ Rights allowing individuals and NGOs to take cases directly to the African Court.

This decision, which was taken on 3 March 2025 and communicated to the President of the African Union Commission on 7 March 2025, increases to five the number of states that have since withdrawn the declaration. This leaves only seven out of the 12 states that had deposited this declaration. The Centre calls on the Government of Tunisia to reconsider the decision. We also urge the African Union and other stakeholders to use all diplomatic and other means to engage the government of Tunisia to reverse this decision.
