The case discussion series for 2023 will commence on 11 April 2023 with the decision of the African Court on Human and Peoples’ Rights on the case against Morocco’s occupation of the Sahrawi Arab Democratic Republic. As the Court itself stated in its decision, this case is unique in terms of the number of respondents and the questions raised.

The webinar will address the following issues:

  • The political and legal context of the complaint;
  • The Court’s approach to defining the limits of individual and collective international responsibility of AU member states towards another state that violates the erga omnes obligation to respect self-determination;
  • The concept of “assistance” of article 20(3) of the Charter in respect of the margin of action for those states to provide their support to the occupied people;
  • The implications of the Court’s decision for the struggle of the Saharawi people for self-determination.
