Good news for authors! Effective March 2026, the African Human Rights Law Journal now publishes articles on a rolling basis, instead of biannually.

We are pleased to share the most recently published articles addressing critical rights issues in Africa. Full versions can be freely accessed in the embedded links:

  1. N Muhumuza‘Children’s rights and climate action: Assessing the suitability of South Africa’s domestic normative framework’: In a thorough normative analysis, this paper demonstrates the disproportionate impact of South Africa’s climate laws on the rights of children, despite robust constitutional guarantees. It makes salient propositions for reforms which would ensure equitable and effective intergenerational climate justice for children.
  1. B Moshoeshoe & M Ntaote‘What’s in a name? Dismantling patriarchy, advancing equality and reclaiming identity in Jordaan v Minister of Home Affairs’: In this paper, the authors demonstrate how courts can be valuable instruments for rewriting societal narratives around patriarchy and equality for both women and men. They probe into the reasoning and laudable progressiveness of the South African courts in a 2025 landmark decision invalidating provisions of the law that hitherto entrenched gendered surname practices.
  1. JA Brauch ‘Is the ECOWAS Community Court of Justice the answer to the religious freedom challenges in West Africa?’: This article critically examines the challenges to asserting the right to freedom of religion before international adjudicatory bodies. Building on success stories of the ECOWAS Court, the author reveals that despite several weaknesses, this Court presents the most promising alternative for such claims within the West African sub region.
